General Terms and Conditions
1. Scope
The following terms and conditions apply to all orders placed via our online shop by consumers and entrepreneurs.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.
These General Terms and Conditions shall also apply to future business relationships with entrepreneurs without the need for us to refer to them again. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.
2. Contractual partners, conclusion of contract
By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the goods in your shopping cart by clicking on the order button.
Immediately after submitting your order, you will receive a confirmation email.
A binding contract may also be concluded beforehand as follows:
· If you have chosen to pay by credit card, the contract is concluded at the time the credit card is charged.
· If you have chosen PayPal as your payment method, the contract is concluded at the time of your confirmation of the payment instruction to PayPal.
· If you have chosen another payment method, the contract is concluded at the time of the debit from your account.
The language available for the conclusion of the contract is German.
3. Delivery conditions, total purchase price
Shipping costs may be added to the product prices indicated. You can find more details about the shipping costs in the offers.
We only deliver by mail order. Unfortunately, it is not possible to pick up the goods yourself. We do not deliver to packing stations.
Shipping usually takes 2-3 business days.
Please note that delivery times for products in high demand may take approx. 1-2 weeks.
4. Payment
The following payment methods are available in our shop:
Credit card
When you place your order, you also provide us with your credit card details.
After you have been verified as the legitimate cardholder, we will immediately request your credit card company to initiate the payment transaction. The payment transaction is carried out automatically by the credit card company and your card will be charged.
PayPal
You pay the invoice amount via the online provider PayPal. You must be registered there or register first, authenticate yourself with your access data, and confirm the payment instruction to us. You will receive further information during the ordering process.
After placing your order, you will be redirected to the website of the online provider SOFORT Überweisung. In order to pay the invoice amount via SOFORT Überweisung, you must have an online banking account with PIN/TAN procedure that is activated for participation in SOFORT Überweisung, identify yourself accordingly, and confirm the payment instruction to us. You will receive further information during the ordering process. The payment transaction will be carried out immediately afterwards by SOFORT Überweisung and your account will be debited.
5. Retention of title
The goods remain our property until full payment has been received.
The following applies additionally to entrepreneurs: We retain title to the goods until all claims arising from a current business relationship have been settled in full. You may resell the goods subject to retention of title in the ordinary course of business; you hereby assign to us in advance all claims arising from this resale, irrespective of any combination or mixing of the goods subject to retention of title with new items, in the amount of the invoice amount, and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves if you do not meet your payment obligations.
6. Cancellation policy
CONSUMERS HAVE A 30-DAY RIGHT OF CANCELLATION.
Right of cancellation
You have the right to withdraw from this contract within 30 days.
The withdrawal period begins on the day on which you take possession of the goods.
To exercise your right of withdrawal, please send us an email to vanessa@outfit-compass.uk with a clear statement of your decision to withdraw from this contract.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period expires. Heavily discounted products are excluded from this.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, excluding delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. You shall bear the costs of returning the goods. You shall be liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing their condition, properties, and functionality.
7. Transport damage
For consumers, the following applies: If goods are delivered with obvious transport damage, please report such defects to the delivery service as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your claims and their enforcement, in particular your warranty rights.
8. Liability
In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.
9. Final provisions
If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our place of business.
